Terms of Service
1. Scope
These Terms of Service (“Terms”) govern your access to and use of the website windalor.com (the “Site”) and any related services provided by Windalor (PE) (“Service Provider”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
2. Service information and consumer protection
The Service Provider provides consumers on the Site with timely, accurate, and publicly available information about the Service Provider and the service being offered, including consumer complaint/rights handling information where applicable. This is provided in accordance with Закон України "Про захист прав споживачів", Закон України "Про захист прав споживачів" (№ 3153-IX від 10.06.2023).
If consumer services are provided in Ukraine, consumer-facing information on the Site is provided in Ukrainian in the required scope for customer service. This requirement is considered under Закон України "Про забезпечення функціонування української мови як державної", Article 30 of the Law of Ukraine "On Ensuring the Functioning of the Ukrainian as the State Language".
3. Visual/diagnostic inspection limits
If the Site includes inspection-report content (including visual or diagnostic information), such content is limited to what can be assessed to the extent of your access to materials and the testing/inspection actually performed. Any inspection results are informational only and are not a substitute for professional assessment of specific conditions by qualified specialists.
4. No guarantees of condition
To the maximum extent permitted by applicable law, the Service Provider does not guarantee the absence of defects, the exact current condition of any subject matter, or that any information on the Site will remain complete, accurate, or applicable after publication.
5. Scope, scheduling, and changes
Any scope descriptions and scheduling information are subject to change due to operational requirements, availability, or other factors. Where applicable, the final scope and timing are confirmed between you and the Service Provider through the specific order/communication channel.
6. User responsibilities
You agree to use the Site only in compliance with applicable law and these Terms. You are responsible for the accuracy of information you provide and for maintaining the confidentiality of any credentials you use to access features of the Site.
7. Liability limits
To the maximum extent permitted by law, the Service Provider is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, or data, arising from your use of (or inability to use) the Site or services.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under mandatory Ukrainian consumer or other applicable laws.
8. Consumer complaints and dispute handling
If you have complaints, you can submit them through the contact channels published on the Site, including by email contact@windalor.com and by phone +380 932 586 868 868. The Service Provider will handle consumer complaints in a manner consistent with Закон України "Про захист прав споживачів" and related requirements. Complaint/dispute information is available on the service site to provide a clear path for submission.
9. Personal data and electronic commerce
If the Site collects personal data (for example, through forms or other identification-linked processing), it is processed lawfully with appropriate grounds and, where required, consent. The Service Provider discloses the purpose and scope of processing. This is governed by Закон України "Про захист персональних даних", On Protection of Personal Data | on June 1, 2010 № 2297-VI.
Where marketing or contracting involves electronic commerce flows, personal data protection and required consents for electronic communications/transactions are handled in accordance with Закон України "Про електронну комерцію".
10. Cookies
If cookies are used for non-essential tracking/advertising or identification purposes, the Service Provider implements a consent mechanism consistent with applicable personal-data consent approaches and discloses purposes. Cookies used as personal data are subject to Закон України "Про захист персональних даних".
11. Electronic communications for marketing
If email/SMS/other electronic marketing messages are used to send communications based on your activity from the Site, such messages are sent only under the required consent and identification/opt-out requirements under Закон України "Про електронні комунікації" (1089-IX).
